Terms of Sale.

The terms and conditions including both General Terms and specific Terms apply to every client (you or your) who purchases or uses information or uses products and/or services from CB Naturopathy (ABN: 72209396218 ) To the extent of any inconsistency in these Terms, the Specific Terms prevail over the General Terms.

Definitions:

Business: Telehealth clinic through website www.cbnaturopathy.com (SITE)

Product: Natural supplements, herbal medicine, creams, educational resources, merchandise.

Services: Naturopathic consult & and personalised treatment plan.

Example: Consult: Telehealth or in-clinic consultation with practitioner and provided advice & and treatment plan. Treatment Plan: advice given on recommendations for actions specific and in general to your provided personal information that we may provide. By using these Products and Services you agree to be bound by these terms as well as the privacy policy and our website Terms of Use which may be provided upon request.

These documents govern the legal relationship between you and us in the use of our Products & Services. In purchasing these Products & Services you accept that you will comply with these Terms and that you are over the age of 18 years old. If you Do not agree you must stop using our Site, Products & Service.

Fees & Payements

We will inform you of our fees upon request at the time of booking or by booking or buying a product you agree to pay the required fee including any fees postage & delivery fees. Or any cancellation or failure to attend fees (Services) as set by Terms. We will provide invoices for fees charged by us for Products & Services.

Prices: All prices are in Australian Dollars. All prices are subject to change with notice. Unless otherwise provided in terms prices for items in orders are fixed once order is confirmed.

GST: if and when required GST is payable on our Products & Services and if payable will be displayed on invoicing. By accepting these terms you agree to pay the required GST.

Payments: Unless otherwise indicated on invoicing or agreed in writing a $30 AUD non-refundable deposit will be required to confirm booking. Upon consultation the remainder of the Consult (Services) payment will be required before receiving any Products or Treatment plans. We accept payments via Stripe or Bank transfer and accept all credit cards excluding American Express and Diners Club.

Refund Policy: If you request a refund on a Service or Product we request you email us a refund request outlining amount for refund and reasoning for request. We will consider your request and notify you within 30 days. We may refuse to provide a refund for Change of Mind.

Disclaimer & Limitations of Liability:

Products & Services: It is the responsibility of yourself to ensure any Product or Service meets your needs. You must consider if your circumstances are appropriate for our services, where appropriate consider consulting with your Health Care Practitioner, or other health care providers.

No Guarantee of outcomes: We do not and will not make any guarantees as to outcomes or results including the cure, or resolution of any disease or condition as a result of using our Products & Services, following our advice and/or recommendations.

Disclaimer: When providing a Product or Services we may provide personalised advice generated using the information you have provided and within our Scope of Practice. We advise that you discuss the advice provided with your health care professionals before undertaking this advice. It is solely up to any actions you undertake, or do not undertake due to recommendations we have provided you, and you will hold us harmless against all losses, costs, and expenses under Australian Consumer Law: Competition and Consumer Act 2010.

Limitation of Liability: We exclude all liability for any damage, or loss of any kind including indirect incidental, special, consequential or exemplary damages including but not limited to use, goodwill, data, cost of procurement of substitute foods or services, or any indirect or direct consequential damages however caused arising our of or in anyway connected with our Products & Services.

Except for liability due to breach of Non-excludable Condition and permitted by law.

Indemnity: You agree to and are liable to indemnify, defend, and hold us harmless against and for any and all claims, suits, liabilities, actions, expenses including, cost of litigation and legal costs resulting directly and indirectly from any information that is inaccurate, not up to date, not complete or misleading or misrepresentation. Any breach of the Terms or the Documents provided. Any misuse of the Products and Services or breaches of laws by you.

Disputes: You agree to cooperate with us at your own expense in handling any and all complaints, disputes, investigations, or litigations that arise form your use of our Products & Services.

Consultations:

Bookings: Bookings will be required to be via Telehealth using Zoom. You will be sent a meeting link when booking in which you will need to access to attend the scheduled appointment time.

Reminders: You will receive a reminder 48 hours before the appointment as a courtesy. It is your responsibility to remember your appointments. Do not rely on this service.

Intake Form: You will be sent an intake form upon booking your initial consult. This is required to be completed prior to your appointment. If you have any questions feel free to email us.

Cancellation or Failure to attend: Things do occur in life that may cause you to reschedule or cancel your appointments. However, we do require 24 hours notice of this to ensure we can allocate time for another client. The failure to notify or attend the appointment without the appropriate timing will result in the $30 AUD deposit provided upon booking, being forfeited. By agreeing to the Terms you agree to this policy.

Refunds: Subject to the Terms and your rights under the Australian Consumer Law, we will not provide a refund for consultations. You are provided opportunities to seek information and ask questions about the Services and consultation process prior to deciding to book an appointment.

Product: By proceeding with your order you accept Terms & Documents. We may use third-party party services that require you to set up an account online and pay for your script prior to having the items sent to you.

Damage: If your Products arrive damaged or faulty take photos and notify us immediately.

Cancellation of Orders: If you have written to us for the cancellation of your product before we have prepared and sent them out, we will not charge you or refund if you have prepaid. If we have created or made up personalised prescriptions for you prior to you requesting a cancellation we will be unable to provide you with a refund as these products will not be able to be resold and therefore require the cost of the products to be paid.

Refund: we do not offer refunds for change of mind on our Products. We do not offer refunds on opened, used, or Products damaged by you, or any personalised products that have been made specifically for you even if unused or unopened as they cannot be reused. If an order is incorrect, made without your permission, or is faulty, damaged, or have a recall notice contact us immediately and we will work with you toward a resolution within our Terms.

Recalls: If a product is recalled we will provide a new product to you. If this happens we will contact you for you to stop use of the product and provide the details of the recall and a new product.

Allergies & Reactions: Some products that are sold may come in contact with or have nuts or other potential allergens or ingredients like gluten/dairy. Some herbal medicines are contraindicated in certain instances such as pregnancy. It is your responsibility to read the ingredients before purchasing a Product and contact us if you have any questions about the Product before purchasing. We will not be held liable for adverse reactions or allergic reactions to Products. We will not refund or exchange Products due to allergies or adverse reactions.
